The Housing Financial Discrimination Act of 1977 Fair Lending Notice / The Holden Act

It is illegal to discriminate in the provision of or in the availability of financial assistance because of the consideration of:

  • Trends, characteristics or conditions in the neighborhood or geographic area surrounding a housing accommodation, unless the financial institution can demonstrate in the particular case that such consideration is required to avoid unsafe and unsound practice, or
  • Race, color, religion, sex, marital status, national origin, or ancestry. It is illegal to consider the racial, ethnic, religious, or national origin composition of a neighborhood or geographic area surrounding a housing accommodation or whether or not such composition is undergoing change, or is expected to undergo change, in appraising a housing accommodation or in determining whether or not, or under what terms, and conditions, to provide financial assistance.

These provisions govern financial assistance for the purpose of the purchase, construction, rehabilitation, or refinancing of one-to-four unit family residences occupied by the owner. In addition, these provisions govern financial assistance for the improvement or rehabilitation of an owner-occupied or investor-owned one-to-four unit dwelling.

Fair Lending Policy

The board of directors, management, and employees of Budget Finance Company are committed to the practices of fair lending. Budget Finance Company will not tolerate discrimination in our lending or business practices on the basis of:

  • race
  • color
  • religion
  • national origin
  • marital status
  • age (providing the applicant is of legal age and has the capacity to enter into a binding legal contract)
  • sex
  • disability
  • familial status
  • receipt of public assistance
  • the exercise of any right under the Consumer Credit Protection Act; or
  • or on any other basis prohibited by state or federal law

Budget Finance Company complies with all fair lending laws and regulations, including the Equal Credit Opportunity Act and the Fair Housing Act. Our company will refrain from any discriminatory practices, including the following:

  • Failing to provide information or services, or providing different information or services, regarding any aspect of the lending process, including credit availability, application procedures, or lending standards to applicants based on a prohibited basis
  • Discouraging or selectively encouraging applicants with respect to inquiries about or applications for credit based on a prohibited basis
  • Refusing to extend credit or using different standards in determining whether to extend credit to applicants based on a prohibited basis
  • Varying the terms of credit offered, including the amount, interest rate, duration, or type of loan based on a prohibited basis
  • Using different standards to evaluate collateral offered by applicants based on a prohibited basis
  • Treating any borrower differently in servicing a loan or invoking default remedies based on a prohibited basis
  • Using different standards for pooling or packaging a loan in the secondary market based on a prohibited basis

If any employee believes that any mortgage loan applicant or borrower has been subjected to any for of unlawful discrimination, he/she should promptly report the facts of the incident or incidents, the names of the individuals involved, and the names of any witnesses to the Compliance Officer. No action whatsoever will be taken against any employee for reporting or opposing any form of unlawful discrimination.

The Compliance Officer will thoroughly and objectively investigate all claims of discrimination as confidently as possible. After the conclusion of any such investigation, the company will make a determination as to the allegation. Any employee found to have engaged in any for of unlawful discrimination will be subject to disciplinary action up to and including termination of employment.

Fair Housing Act

The Civil Rights Act of 1968, as amended by the Fair Housing Amendments Act of 1988.

It is illegal to discriminate against any person because of race, color, religion, sex, handicap, familial status (having one or more children), or national origin:

  • In the sale or rental of housing residential lots.
  • In advertising the sale or rental of housing.
  • In the financing of housing.
  • In the appraisal of housing.
  • In the provision of real estate brokerage services.

Blockbusting is also illegal.
